Standup Paddleboard Rental Terms and Conditions

By hiring paddleboard equipment from In Your Element, you are acknowledging and agreeing to the following:

  1. We recognise that watersports can be dangerous & we acknowledge the risks involved.
  2. We acknowledge that the paddleboard provided to us is designed for use on flatwater and that conditions can change quickly even in a sheltered, flatwater environment.
  3. We acknowledge that hired paddleboards are to be used in a manner that suits our experience levels, and that leashes will be used when appropriate.
  4. We acknowledge that In Your Element recommends the use of a wetsuit and buoyancy aid when using our hired paddleboards, as well as exercising caution near shallower areas to avoid injury or damage.
  5. Any damage to wetsuits or boards due to misuse or negligence is the customer’s responsibility & will be charged for.
  6. In Your Element reserves the right to refuse hire to a customer if it is suspected they are under the influence of alcohol or drugs.
  7. Late returns may be charged at £10.00 per board per hour or part thereof. If we are unable to return the board(s) to the hire shop, then a collection fee of £10 per board will be charged to collect them from a roadside location within a 10-mile radius. Collection from further afield will cost an additional £2 per mile.
  8. Cancellations: Hire bookings will be refunded in full, only if In Your Element is notified at least 48 hours before your booking is due to start.

Competence & Risk

  1. By signing this agreement, you explicitly accept that all members of your party are competent to use the hired equipment unsupervised.  If you have any doubts about the competence of the group, you should book an In Your Element guide to accompany you and ensure the safety of the group. You and members of your group use this equipment entirely at your own risk.
  2. We reserve the right to refuse the hire of equipment if we have concerns about alcohol consumption, the conduct of the group, or their safety during the period of hire.  A full refund for the Equipment Hired will be given, but the equipment delivery fee will be retained.

Liability

  1. Members of your party are only insured by In Your Element for injury caused by the failure of our equipment when it is used for the purpose intended.
  2. We strongly recommend that you take out insurance to cover your travel arrangements and your participation in outdoor pursuits.
  3. We strongly recommend that you have civil liability insurance cover in place in case your paddling activities result in injury or loss to third parties (e.g. fishermen).  Civil liability insurance comes with Scottish Canoe Association membership and is available online at www.canoescotland.com for c.£20 for Adult Recreational membership.
  4. We have no way of telling which member of a group is responsible for loss and/or damage to equipment, and so it is the group organiser who we will hold liable for compensating In Your Element for lost and or damaged equipment.  We suggest that you discuss the issue of financial liability with your group prior to confirming your booking.
  5. Where delivery and collection is agreed in advance, in order that we can keep shuttle costs to a minimum, your driver will be booked to work for a set number of hours depending on the route in question.  If our driver and vehicle are kept waiting for more than 15 minutes beyond the appointed shuttle meeting time, then you will become liable for an additional charge of £25.00 per hour or part thereof. If you wish to change your collection time during your hire period, you must give us as much notice as possible.  However, our ability to meet you at the new requested time will be dependent on staff & vehicle availability at the time.
  6. Extra carriage charges may have to be made if boards have to be picked up from a location other than the agreed termination point (IYE Bike Pavilion)
